Privacy policy

This Privacy Policy explains what information HomeworkGrader collects, how we use it, and the choices you have. It applies to homeworkgrader.com and any related applications operated by FIRM AI, Inc..
Who we are
HomeworkGrader (the "Service") is operated by FIRM AI, Inc. ("HomeworkGrader," "we," "us," or "our"), a Delaware corporation. The Service is a web application that uses artificial intelligence to grade student homework that you upload as images or PDFs. This Privacy Policy describes how we collect, use, and disclose information through the Service.
Who the Service is for
The Service is intended for use by educators, school staff, and other adults eighteen (18) years of age or older. The Service is not directed to children under thirteen (13), and we do not knowingly collect personal information directly from children under thirteen.
Educators using the Service may upload student work that contains student names or other identifiers. Where this information constitutes an "education record" under the Family Educational Rights and Privacy Act (FERPA), the educator is the record-holder and we act as a service provider processing that information on the educator's behalf and under their direction.
Information we collect
Information you provide
- Uploaded content. Images, scans, and PDFs of homework you submit for grading, together with any rubric text you choose to include.
- Account information (if and when accounts are introduced). For example, an email address used to sign in.
- Communications. Information you send us when you contact support, including the contents of your message and your email address.
Information collected automatically
- Usage data. Basic information about how the Service is used, including timestamps, page paths, the approximate number of pages processed, and the model responses returned.
- Device data. Browser type, operating system, approximate region derived from IP address, and crash or error diagnostics. We do not collect precise geolocation.
- Cookies and similar technologies. See our Cookie Policy.
How we use information
We use the information described above to:
- Provide, operate, and maintain the Service, including processing uploads, generating grading output, and returning results.
- Diagnose problems, investigate misuse, and protect the security and integrity of the Service.
- Communicate with you, including responding to support requests and sending administrative messages.
- Comply with our legal obligations and enforce our Terms of Service.
- Measure aggregate usage and improve the quality and accuracy of the Service.
We do not use uploaded student work, rubric text, or grading output to serve advertising, to build advertising profiles, or for any purpose unrelated to providing the Service.
How we handle uploads
Uploaded files are transmitted to third-party providers strictly as needed to produce a grading result.
Third-party providers
We rely on third-party providers to operate the Service, including cloud-hosting providers and one or more third-party providers of artificial-intelligence services that perform the underlying grading.
We use PostHog to understand how teachers use the Service, to find errors, and to see where it is slow. PostHog receives the pages you visit, the actions you take (such as grading a class or exporting results), technical details about your browser and device, and your account email so we can follow up on problems you run into.
When you are signed in, PostHog may also record your sessions in the grading workspace so we can see where the Service is confusing or slow. These recordings hide all text you see or type and block student pages, photos, and the camera, so student work and student names are never recorded. PostHog processes this data in the United States on our behalf under a data processing agreement.
We also use providers for email delivery. We do not sell personal information to any third party.
Data retention
- Account information (when applicable): retained while the account is active and for a reasonable period afterward.
- Operational logs: retained for up to ninety (90) days for security and debugging purposes, then deleted or aggregated.
- Support communications: retained for up to two (2) years.
Data security
We use commercially reasonable technical and organizational measures to protect information processed by the Service, including encryption of data in transit, access controls, and monitoring. No method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
If you believe your account or the Service has been compromised, please contact support@homeworkgrader.com immediately.
Your choices and rights
Depending on your jurisdiction, you may have the right to access, correct, delete, or restrict the processing of personal information we hold about you, and to object to certain processing activities. To exercise any of these rights, contact support@homeworkgrader.com. We will respond within the timeframes required by applicable law and may need to verify your identity before fulfilling a request.
California residents
California residents have rights under the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA"), including the right to know, the right to delete, the right to correct, the right to opt out of the sale or sharing of personal information, and the right not to be discriminated against for exercising these rights. We do not sell personal information and do not share it for cross-context behavioral advertising.
EEA, UK, and Swiss residents
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you may have additional rights under the General Data Protection Regulation (GDPR) or equivalent legislation, including the right to lodge a complaint with a supervisory authority.
Student records and FERPA
When an educator uploads student work that constitutes an education record under FERPA, we process that information as a "school official" performing services that the educator's school would otherwise perform itself. We use student information only for the purpose of providing the Service to the educator, do not re-disclose it except as permitted by FERPA, and do not retain it beyond the period needed to deliver the grading result.
Educators are responsible for ensuring that their use of the Service complies with their school's policies, applicable parental consent requirements, and any local data-handling obligations.
Children's privacy
The Service is not directed to children under thirteen (13), and we do not knowingly collect personal information directly from children under thirteen. If you believe we have inadvertently collected such information, please contact support@homeworkgrader.com and we will take reasonable steps to delete it.
International transfers
We are based in the United States and may process information in the United States and other countries. Where required, we rely on appropriate safeguards (such as standard contractual clauses) for international data transfers.
Changes to this policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide a more prominent notice. Your continued use of the Service after a change becomes effective constitutes your acceptance of the revised policy.
